Terms of Service

Fivemania provides the technology platform that allows Sellers to list, promote, and deliver digital FiveM assets (scripts, MLOs, vehicles, clothing, and similar digital goods) to Buyers. Our role is to:

• Host listings, product files, and Seller storefronts
• Process orders and payments through third-party payment processors
• Deliver purchased files and manage download access
• Review listings and moderate the marketplace
• Mediate disputes between Buyers and Sellers under our policies

Curation note: we review listings before they go live and remove content that violates our policies, but we do not and cannot guarantee that every product is error-free, fit for your purpose, or non-infringing. See Sections 9, 13, and 14.

To use our Services, you must:

• Be at least 13 years old (per Discord's Terms of Service)
• Be at least 18 years old (or the age of majority in your jurisdiction) to make purchases or sell on the platform
• Have the legal capacity to enter into a binding contract
• Not be barred from using our Services under applicable law or sanctions
• Provide accurate, complete, and current information when required

If you use our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Accounts are created by signing in with Discord. When you create an account you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your Discord account and session
• Notify us immediately of any unauthorized access
• Take responsibility for all activity under your account

We may suspend or terminate accounts that violate these Terms, our policies, or applicable law, or that engage in fraud or abuse.

Refunds for all marketplace purchases are governed by our Refund Policy, which applies platform-wide and binds Sellers. In short: sales of digital goods are final, with a narrow exception for products that are genuinely broken and cannot be fixed within 14 days. Fivemania administers refund requests on behalf of Sellers.

When you purchase a product, the Seller grants you a license to use it. Unless the listing expressly states different terms, the default marketplace license is:

Licenses are granted by the Seller and are non-exclusive, non-transferable, and conditioned on compliance. If you materially breach the license, it terminates automatically: access may be revoked, you must delete all copies, and no refund is owed. Fivemania may enforce this license framework on the Seller's behalf.

Fivemania itself offers optional platform memberships (such as VIP tiers). These are products of Fivemania LLC, not of Sellers. By subscribing you agree to be charged the stated fee at the stated interval until you cancel.

• Auto-renewal: subscriptions renew automatically unless canceled before the next billing date
• Cancellation: cancel anytime from your account or via a support ticket; benefits continue until the end of the current billing period
• No partial-period refunds, except where required by law or under the Refund Policy
• Price changes take effect at the next renewal after reasonable advance notice

The platform may offer development-related services (for example fixes, modifications, configuration, or custom builds) fulfilled by Fivemania or by independent providers, as identified in the service order. For custom work, the scope, price, payment schedule, and revision allowance are as agreed in the service order or ticket before work begins. Unless agreed otherwise in writing:

• Deposits become non-refundable once work has started
• Work completed up to a cancellation is charged and non-refundable
• Additional scope is quoted and billed separately
• Custom deliverables are licensed to you under the same default license as Section 6 unless the order states otherwise

Listings, product files, images, descriptions, reviews, and Seller storefronts are content provided by users, not by Fivemania. We review listings before publication and act on reports, but we do not endorse, warrant, or assume responsibility for Seller content. If you believe a listing is broken, misleading, malicious, or infringes someone's rights, report it via a support ticket or [email protected] (see the IP & DMCA Policy for copyright notices).

You agree not to:

• Use our Services for any illegal purpose
• Upload, sell, buy, or request content you do not have the rights to, including leaked, stolen, "nulled," or cracked assets
• Upload malware, backdoors, remote kill switches, or harmful or deceptive code
• Sell or distribute cheats, exploits, or tools designed to disrupt servers or players
• Harass, threaten, or abuse other users or staff
• Impersonate others or misrepresent your affiliation
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, crawl, or systematically extract content or data from our Services
• Circumvent download limits, license enforcement, fees, or security measures
• Manipulate reviews, ratings, or marketplace rankings

Violations may result in content removal, account termination, forfeiture of pending payouts to the extent permitted by law, and referral to law enforcement.

FiveM is a third-party platform with its own terms and policies (including the Cfx.re Terms of Service and platform license agreement). You are responsible for ensuring that your use of any product purchased on Fivemania complies with those terms and with the rules of any server, host, or service you use. We are not responsible for actions taken by third-party platforms, including bans, policy changes, or technical changes that affect products you purchased.

Some jurisdictions do not allow certain warranty exclusions; where that is the case, the above applies to the maximum extent permitted.

To the maximum extent permitted by law:

• Fivemania LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, server downtime, player loss, or business interruption
• We are not liable for the acts, omissions, content, or products of Sellers or other users, or of third-party platforms and payment processors
• Our total aggregate liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100

Some jurisdictions do not allow these limitations; they apply to the maximum extent permitted, and nothing in these Terms excludes liability that cannot be excluded by law.

You agree to indemnify and hold harmless Fivemania LLC and its members, managers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Services; (b) content you upload, list, or sell; (c) your violation of these Terms or of applicable law; or (d) your infringement of any third party's rights.

You may stop using the Services at any time and may request account deletion via support. We may suspend or terminate your access (in whole or in part) if you violate these Terms or our policies, if required by law, or to protect the platform and its users. Sections that by their nature should survive termination (including licenses already granted to delivered products, payment obligations, disclaimers, liability limits, indemnification, and dispute terms) survive.

• Entire agreement: these Terms plus the policies they reference are the entire agreement between you and Fivemania LLC regarding the Services
• Severability: if a provision is unenforceable, the rest remains in effect
• No waiver: our failure to enforce a provision is not a waiver of it
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control

We may update these Terms from time to time. Material changes will be announced on the site and/or in our Discord at least 14 days before they take effect, except for changes required by law or addressing new features, which may be effective immediately. Continued use of the Services after the effective date constitutes acceptance. The "Last Updated" date above always reflects the current version.
