Intellectual Property & DMCA Policy

Fivemania is a marketplace where independent creators sell their own work, and we take intellectual-property rights seriously — the platform exists to protect creators from leaks and theft, not to enable them. Fivemania LLC responds to notices of claimed infringement in accordance with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and comparable laws worldwide, and terminates repeat infringers.

If you believe content on fivemania.com infringes your copyright, follow the process below. Products are uploaded by third-party sellers; where the law provides, Fivemania acts as a hosting intermediary for that seller content.

1. Filing a Copyright Infringement Notice

Send your notice to [email protected] with the subject line [DMCA]. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:

  1. Identification of the copyrighted work you claim is infringed (or a representative list if there are several)
  2. Identification of the infringing material and where it is located on our site (direct listing URLs, e.g. fivemania.com/assets/<id>)
  3. Your contact information: name, mailing address, telephone number, and email
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  6. Your physical or electronic signature

Evidence that speeds things up (not legally required, but helpful): proof of authorship or first publication, original source files, purchase pages on other platforms, or code excerpts showing copying.

2. What Happens After a Valid Notice

  • We act expeditiously — normally within 24-48 hours — to remove or disable access to the identified material
  • We notify the seller who uploaded it and provide them a copy of the notice
  • The seller may respond with a counter-notification (Section 3)
  • We keep records of notices and outcomes and apply strikes under our repeat-infringer policy (Section 4)

3. Counter-Notification

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to [email protected] including:

  1. Identification of the removed material and its former location
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the federal courts of Montana), and that you will accept service of process from the person who filed the original notice
  4. Your physical or electronic signature

If we receive a valid counter-notification, we forward it to the original complainant. Unless they notify us within 10-14 business days that they have filed a court action, we may restore the material.

4. Repeat-Infringer Policy

We terminate, in appropriate circumstances, the accounts of users and sellers who are repeat infringers. Confirmed uploads of leaked, stolen, cracked, or plagiarized content may result in immediate permanent termination on the first offense, forfeiture of pending payouts to the extent permitted by law, and reporting to payment partners.

5. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Do not file false notices — they can also result in a platform ban.

6. Trademark & Other IP Complaints

For trademark complaints (e.g., a listing using your brand or logo without authorization) or other intellectual-property concerns, email [email protected] with the subject [IP Complaint], identifying your rights (registration numbers where applicable), the listing URLs, and the harm. We review and act on valid trademark complaints similarly to copyright notices.

General (non-legal) questions belong in support channels — using them keeps the legal queue fast for real notices.

8. Sellers: Your Responsibility

Sellers warrant under the Seller Agreement that they own or have rights to everything they upload. Uploading someone else's work — including "fixed," "improved," deobfuscated, or re-skinned versions — is a material breach and will be treated under the repeat-infringer policy above.
